SHORT TERM RENTAL AGREEMENT

 

This Rental Agreement is made by and between

 

(Landlord) and

 

(Tenant) as of the date last set forth on the signature page of this Rental Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

1.     Property:  The property, Homeaway ID:                            ,  is located at __                                    Township of                    , County of                    in the Commonwealth of Pennsylvania , _                                 _ with improvements consisting of _

           

2.     Maximum Occupancy:  The maximum number of guests is limited to ____ persons,  (not to exceed ____ adults).  An additional charge of $________per person per night for guests in addition to ______ will be assessed.  Only persons stated in the space below can stay in the property, the property cannot be sublet.   

 3.     Tenants:  The Tenants as occupants shall consist of:  See below

4.     Term of Lease:  The lease begins at 4:00 p.m. on Click or tap here to enter text. (Check-in Date) and ends at 11:00 a.m. on Click or tap here to enter text. (Check-out Date).

5.     Minimum Stay:  This property requires a _2__ night minimum stay.  Longer minimum stays may be required during holiday periods. 

6.      Rental Rules:  By signing this lease, tenants agree to abide by the Rental Rules attached including but not limited to those established by a Property Owner Association, if any, at all times while at the property and shall cause all members identified above and anyone else who may be their guest to abide by the following rules at all times while at the property. If any community fees are incurred due to negligence and misbehavior from tenant and/or tenant’s guests, you will be subject to covering these fees with your security deposit or a personal check. If you are staying in a community, you can refer to the community rules and will need to provide a signed copy.

7.     Access:  Tenants shall allow Landlord access to the property for purposes of repair and inspection, or any emergency condition.  Landlord shall exercise this right of access in a reasonable manner under the Then current circumstances.

8.     Rental Rate and Fees:  We can only hold dates for 5 days without a deposit. 25% of the full rental amount is due at booking and 75% is due within 30 days of rental dates. If booking is made within 30 days of rental dates, the payment will be due in full, at time of booking. If the full balance is not received by this time, we reserve the right to cancel your booking.

 Security Deposit: If applicable, a security deposit of $_500.00 has been added to your rental amount and is to be used for items listed below and shall be refunded within 15 days of the Checkout Date provided no deductions are made due to:

i.   Fines incurred by Tenant violating community rules and regulations

ii.  Any other cost incurred by Landlord due to Tenant’s occupancy

 The landlord will provide to Tenant written notice of any of the above.  In addition, if applicable, the Tenant will secure a Property Damage Protection Plan from VRBO.  Any damage caused by the Tenants or their guests will be submitted as a claim.  If not covered by the Plan, the Tenant will remain liable for the following.

 Tenants shall inspect the premises upon check-in.  If not acceptable because of damage or uncleanliness, the Tenants take occupancy as-is and waive any claims made for damage or uncleanliness after they take occupancy.  By taking occupancy under those conditions, the Tenant may assume responsibility for any cleanup or repairs.

9.     Cancellation Policy:  If Guest cancels 60 days prior to the agreed rental date, then 100% refund will be made. Any cancellations made after 30 days, 50% refund will be given.

10. Insurance:  We encourage all renters to purchase traveler insurance to protect them should a cancellation at the last minute be necessary. You can purchase insurance through the HomeAway web site.

The owners of the property or their agents will not be liable for loss or delay due to any of the following: - strikes, riots, political unrest, hostilities, war or threat of war, terrorist activity, closure of airports, or any other event beyond the owners control including inclement weather (snow storms!)

Tenants understand that the Landlord’s insurance does not cover them or the Tenant’s guest, who may be injured.

 Tenants are responsible to secure their own insurance coverage and are encouraged to do so as their guests are their responsibility.

Tenants are responsible for any damage, fines, or injury caused by Tenant, Tenant’s family or Tenant’s guests, including any attorney fees associated with the loss that the Landlord may incur.

I agree that all rental monies are non-refundable per the cancellation policy above.  I have read my right to purchase travel insurance.

SECTION I:  RECOVERY OF SECURITY DEPOSIT

The Landlord shall, within fifteen (15) days of termination of this lease, or upon surrender and acceptance of the leasehold premises, whichever occurs first, provide Tenant with a written list of any damages to the leasehold premises for which the Landlord claims the Tenant is responsible as well as payment of the difference between security deposit and damages as claimed by Landlord not covered by the Property Damage Protection Plan.  Landlord will allow the Tenant ten (10) days to respond prior to releasing the balance of the security balance to the Tenant.  In the event of a dispute, monies disputed will remain in escrow until both parties reach a mutual resolution or a court with jurisdiction over such matters makes a determination.

If the Landlord fails to provide a written list within fifteen (15) days as required above, the landlord shall forfeit all rights to withhold any portion of the security deposit.  However, if within thirty (30) days of termination of this lease, the Landlord claims possession of the escrow funds for non-payment of rent or other breach in this Rental Agreement as provided in Section _8__, the escrow agent shall release the funds to the Landlord and notify the Tenant of the release of said funds.

SECTION II:  SURRENDER OF POSSESSION

Tenant agrees to surrender possession of the property hereby leased at the expiration of this lease, peaceably and without delay, and in as good a condition as it was at the commencement of this lease, reasonable wear and tear, act of God and/or other causes over which the tenant has no expected control.

SECTION III:  WASTE AND NUISANCE

Tenant shall not allow any waste or nuisance to occur on the premises nor allow premises to be used for an unlawful purpose.  Illegal substances, narcotics, unlicensed firearms, fireworks or any other such items will not be permitted on the subject premises.

SECTION IV:  TENANT’S MAINTENANCE AND REPAIRS

                        TENANT SHALL

a.)  Pay for all repairs, replacements, and damages caused by the act or neglect of the tenant, their family, or guests.

b.)  Keep and maintain the house and grounds in a neat, clean safe condition. Vehicles may be driven or parked only in the driveway or designated parking areas.  The tenant shall not allow the injury to the landscaping.

c.)  Take diligent care of the house and all fixtures and furnishings contained herein.

e.)  Keep nothing in the house which is flammable or might increase the risk of fire or casualty.

f.)  Promptly notify the Landlord of any conditions needing repair.

g.)  Promptly remove all trash and household garbage from premises.

h.)  Use all-electric, plumbing, and other facilities in a safe manner.  This includes avoidance of overloaded sockets, fires larger than safely accommodated in fireplace, etc.

i.)   Do nothing which might cause an increase in the premium or cancellation of the landlord’s liability or fire insurance.

j.)  Obey written instructions of the Landlord for the safe use of appliances,  equipment, and other personal property in the house.

k.)  Do nothing which destroys, defaces, or removes any part of the subject premises.

l.)  Promptly comply with all orders and rules of the Property Owners Association, Board of Health, Township Ordinances, or any other authorities governing the house which are directed at the Tenant.

m.)  Do nothing to destroy the peace and quiet of the Landlord, other tenants, or neighbors.

n.) Notwithstanding anything herein to the contrary, Tenant will pay the cost of any or all repairs of any kind whatsoever, occurring after the commencement of this lease where the individual cost of each repair is less than $__500.00____.

 SECTION V:  TENANT INSPECTION AND OCCUPANCY

Tenant acknowledges that he has personally inspected the demised property and accepts it in an “as is” condition or if he has not inspected the property, agrees upon entry to report immediately to Landlord or his agent any deficiencies before taking occupancy.

BY THE ACT OF OCCUPANCY, TENANT AGREES THAT THE PREMISES ARE IN GOOD SOUND AND RELIABLE CONDITION AND THAT IF THEY ARE NOT PERSONALLY ACQUAINTED WITH THE CONDITION OF THE PREMIST THAT THEY WILL IMMEDIATELY MAKE AN INSPECTION THEREOF TO DETERMINE ANDY WEAKNESSES THAT MAY RESULT IN INJURY TO THEM, THEIR CO-OCCUPANTS, FAMILY, GUESTS, AND FURTHER THAT THEY WILL INDEMNIFY AND HOLD HARMLESS LANDLORD AND/OR LANDLORD’S AGENT FOR ANY INJURIES, ACCIDENTAL OR OTHERWISE, THAT MAY BE INCURRED OR SUFFERED UPON THE PREMISES FOR ANY CAUSE WHATSOEVER DURING THE TERM OF THIS LEASE.

The tenant is required to surrender the premises in “as good and clean condition” as it was at the beginning of occupancy.

SECTION VI:  USE OF PREMISES BY TENANT

It is hereby understood and agreed by the Tenant that the subject premises shall be used for vacation purposes only and in compliance.

SECTION VII:  DAMAGES

The Tenant is liable for all damages caused by the Tenant’s violation of any agreement in this lease.  This includes reasonable attorney’s fees and costs.

SECTION VIII:  DEFAULT BY TENANT

Should the Tenant default for twenty-four (24) hours in any of the above-scheduled payments, or give Landlord or Landlord’s Agent a check, draft or money order for any payment which is not immediately collectible, Landlord or Landlord’s Agent may, without suit, court order, or notice to Tenant, re-enter and take possession of the premises.  Upon re-entry under any of the above occurrences, Tenant shall forfeit, as liquidated damages, any payment made prior thereto.  In addition to the liquidated damages provided above, the Tenant shall be liable for any other such damages as may be collectible by law.

SECTION IX:  COMMUNITY RULES

Tenant agrees to abide and be governed by the rules and regulations of any Association of Property Owners governing the subject community, as well as the by-laws and protective covenants of that Association, if any, or any posted rules of Landlord or Landlord’s agent. Failure to comply with the rules and regulations may result in immediate removal from premises, without refund.

 Community Fines

If any community fines are incurred due to negligence and misbehavior from the tenant and/or tenant’s guests, you will be subject to cover these fees with your security deposit or a personal check. If you are staying in a community, you can refer to the community rules and will need to provide a signed copy.

SECTION X:  REALTOR AS AGENT FOR LANDLORD

It is mutually agreed that Weichert, Realtors-Paupack Group is acting as an agent only and has no liability to either party for the performance or non-performance of any term or covenant of this lease.

SECTION XI:  NOTICE TO QUIT

The Tenant waives the notice to quit requirements under the Landlord-Tenant Act and Tenant further agrees to surrender said premises at the expiration of the said term, or the termination of this Lease, or any renewal thereof, without any notice whatsoever.

SECTION XII:  CONSTRUCTION AND ENFORCEMENT

This lease shall be construed and enforced in accordance with the laws of the Commonwealth of Pennsylvania.

SECTION XIII:  LIABILITY

I (we) hereby voluntarily accept all risk of personal injury, death, and property damage (including personal property) to myself (ourselves), our family or anyone on the Premises during our lease term, which injury or damage results from our use of the Premises.  Furthermore, I (we) agree that I (we) will not make a claim against or sue the Owners, Weichert Realtors, Paupack Group, its owners or employees, family or related entities, for any bodily injury, death, or property damage.  I (we) understand that this is a release of the Owner and agents from any and all liability with respect to any claims brought for any damage or injury.

SECTION XIV:  FURTHER CONDITIONS

The following addenda describing conditions, forfeitures, covenants and restrictions are a part of this lease and each is binding upon all parties:

House Rules

breaking any of these rules may result in forfeiting some or all your security deposit and possibly being asked to leave.

Check out time is 11 AM for all registered guests.  NO UNREGISTERED GUESTS ARE ALLOWED

❖     Renters shall only utilize the property they rent.  No trespassing on neighboring yards/driveways

❖     NO PETS MEANS NO PETS.  If you are in a Pet Friendly house, then enjoy your Furbabies.             

**If you have rented a Non-Pet Friendly Home, please do not try and “sneak” your very well behaved, non-shedding, hypoallergenic, better than my children, no barking, DOG into our home.  We will find out and you will be asked to leave and pay for extra cleaning. 

❖     Please be considerate of neighboring properties at all times. Quiet time is observed from 11:00PM to 8:00AM daily.  Fires are to be extinguished, all loud music turned down and loud voices kept to a min.

❖     Renters will not act in a disorderly or unlawful purpose or in a manner offensive or annoying to the others and will comply with all applicable Federal, state, county and local laws and ordinances. 

❖     No Eating or Drinking on furniture/beds or in any carpeted area of the house.  (except in area where dining rooms are carpeted). Please respect our property. 

❖     Renters should park on rented property only. Renters are responsible for not blocking any traffic on the roads.  Please obey all posted speed limits.  Security will stop and give citations if speeding in applicable communities. 

❖     Please NO SMOKING!!  This includes vaping and use of illegal substances.  Smoking outdoors is allowed and correct disposal of butts is appreciated.

❖     NO Fireworks (NO KIDDING) or Discharging of Firearms of any kind in or around the house, including BB guns, pellet guns and/or air rifles.   

❖     Regarding the gas GRILL, please make certain to TURN OFF PROPANE after each use to avoid leakage or accidents.  You will find an extra gas tank somewhere located on the deck area if you run out.  You MUST CLEAN the Grill after using it or at the least before you vacate the guest house.  NO EXCEPTIONS!

❖     Regarding campfires, fire must be contained within fire specific areas. Wood should be brought or bought. Please make yourself aware of any burning bans there may be in the area. Be watchful of the height of the campfire as overhanging trees may catch fire easily. Keep a hose or a bucket of water nearby. Do not cut trees on the property, even if the trees appear to be dead. Lake regulations forbid beach fires. Please only have a fire in designated areas. Please do not leave a fire unattended and make sure the fire is completely extinguished after use.  

❖     Regarding Trash, Unless otherwise instructed in your individual Welcome Guide, trash is to be kept in the trash cans provided. Please do not leave any garbage bags outside of the trash cans for there is wildlife all around you. All garbage must be bagged, please no loose garbage in the outside cans. Please RECYCLE during your visit to allow maximum room in cans for garbage. This is NOT TO BE BAGGED but put in the recycling cans loose.  Trash pickup is ONCE A WEEK.  Please consolidate and keep trash to a minimum. 

❖     We understand that sometimes fun creates messes.  Please clean up after yourself to ensure the house will be in the same condition in which it was when you arrived.
